MINUTES


(1) CALL TO ORDER:

Pursuant to due call and posted notice thereof, the regular meeting of the Victoria City Council was called to order at 6:30 p.m. by Mayor Hershberger Thun in the Council Chambers.

Roll Call:

Members Present: Mayor Mary Hershberger Thun; Councilmembers: Tom O'Connor, Jim Crowley, Kim Roden and Tom Strigel.

Absent: None.

Staff Present: Don Uram, City Administrator; Holly Kreft, Community Development Director; Mike Norton, City Attorney; and Cara Geheren, City Engineer.

Others Present: Sue Orsen, The Victoria Gazette; Unsie Zuege, The Chanhassen Villager; and others.
 

(2) ADOPT AGENDA:

A motion was made by Councilmember O'Connor, to adopt the agenda. The motion was seconded. With all members voting in favor, the motion carried. Vote: 5 Ayes, 0 Nays.

(3) CITY ORGANIZATION / PROTOCOL:

-A- City Council Member Assignments, Consulting Staff, Fire Department Officers, Other Commissions and City Protocol/Miscellaneous Appointments

Mr. Uram asked for a volunteer to serve in the Mayor Pro Tempe position, and Councilmember Strigel volunteered.

Mr. Uram asked to be considered the alternate representative for the LMCC meetings, with Councilmember Crowley being considered the primary representative. The Council agreed.

A motion was made by Councilmember Roden, to Approve Resolution No. 12-01 Approving City Council Member Assignments, Consulting Staff, Committee/Commission Appointments, Fire Department Officers, City Protocol/Miscellaneous Appointments, as amended. The motion was seconded. With all members voting in favor, the motion carried. Vote: 5 Ayes, 0 Nays.

Mayor Hershberger Thun removed the December 12th City Council meeting minutes.

A motion was made by Mayor Hershberger Thun, to Adopt the amended consent agenda. The motion was seconded. With all members voting in favor, the motion carried. Vote: 5 Ayes, 0 Nays.

Mayor Hershberger Thun asked that on page 3, her comments under 2012 Fee Schedule be modified to read: "Mayor Hershberger Thun clarified the charges for barricades are used only for block parties."

A motion was made by Mayor Hershberger Thun, to Approve the Minutes of the December 12, 2011 City Council Meeting, as amended. The motion was seconded. With all members voting in favor, the motion carried. Vote: 5 Ayes, 0 Nays.
 

(7) PAYMENT OF BILLS:

-A- Approve the January 9, 2012 Claims Roster in the amount of $149,745.23

A motion was made by Councilmember Strigel to Approve the January 9, 2012 Claims Roster in the amount of $149,745.23 as submitted. The motion was seconded. With all members voting in favor, the motion carried. Vote: 5 Ayes, 0 Nays.

(9) PUBLIC HEARING:

-A- 2nd Reading and Public Hearing of an Ordinance Amending Chapter 16: Curfew

Mr. Uram stated at the previous discussion on the ordinance was to align the City's ordinance with the County's ordinance. He noted a Boy Scout in attendance would like to speak regarding this.

Mayor Hershberger Thun opened the public hearing at 6:42 p.m.

Kyle Simon, Troop 337 in Victoria, stated a requirement of his citizenship merit badge is to ask a question of the Mayor, so he decided to ask about the inconsistency of the two ordinances.

Mr. Uram noted if the Council is interested in being consistent, this should be approved; another option is to repeal the City ordinance so only the County ordinance would be in effect.

Mayor Hershberger Thun asked Mr. Simon if the curfew poses a problem. Mr. Simon responded the curfew does not impact him, but it does affect other students who stay out later.

Mayor Hershberger Thun closed the public hearing at 6:46 p.m.

Councilmember O'Connor asked for the staff recommendation. Mr. Uram recommended repealing the ordinance.

Councilmember Crowley commented that State law requires the City to follow the County law, and he agreed with repealing the ordinance.

Mr. Norton suggested a motion be made to approve the rescission of the curfew ordinance.

A motion was made by Councilmember Crowley to not approve the second reading of the ordinance and to rescind the Ordinance in Chapter 16 Article 2. The motion was seconded. With all members voting in favor, the motion carried. Vote: 5 Ayes, 0 Nays.

(12) REPORTS OF THE CITY ADMINISTRATOR:

Mr. Uram reported the snowplow budget is doing very well this year. Mayor Thun asked how much the City has saved so far in budgeting this year, and Mr. Uram responded he is not sure of the exact figure.
 

(13) REPORTS OF THE MAYOR, COUNCIL MEMBERS, ATTORNEY, COMMITTEES:

Mr. Norton reported on a case in the City of Redwing regarding the use of Administrative Search Warrants. He stated such a warrant is an effective tool if used sparingly and appropriately in an effort to maintain the quality of housing in the City.

Mayor Hershberger Thun reported on the recent Southwest Coalition Transportation Coalition meeting. She highlighted the upcoming Highway 5 project, which will begin right after Memorial Day and will extend through Labor Day. The $10 million project includes an incentives-based clause that pays the contractor $10,000 per day if Highway 5 is closed fewer days than expected. Alternatively, the contractor will incur a penalty of $10,000 per day for each day the work goes over the designated timeframe.

Mayor Hershberger Thun also cautioned residents that there will be periods of time when it appears no work is being done, as the dirt needed to fill a sink hole requires several weeks to settle.

Mayor Hershberger Thun stated the City will not shut down during this construction period, and the Volksfest will still occur August 17 and 18. She also noted that the underpass by Minnewashta will be vital to the area, though the work done on Highway 41 will not occur at the same time as the work on Highway 5.

In response to a question by Councilmember Roden, Mayor Hershberger Thun outlined the improvements to be made near the Arboretum.

Councilmember Hershberger Thun noted the Council will be conducting Mr. Uram's performance review in a closed session, which is something done at least once per year. There will be a general summary and it will come before the Council to approve at a future date.

A motion was made by Councilmember O'Connor, to adjourn the meeting to a Closed Session to discuss City Administrator Employee Review at 7:12 p.m. The motion was seconded. With all members voting in favor, the motion carried. Vote: 5 Ayes, 0 Nays.
 

(16) ADJOURNMENT:

A motion was made by Councilmember Crowley, to adjourn the meeting at 8:20 p.m. The motion was seconded. With all members voting in favor, the motion carried. Vote: 5 Ayes, 0 Nays.
