CITY OF VICTORIA
REGULAR
PLANNING COMMISSION MEETING
MARCH 4, 2008
MEETING
Pursuant to due posted and mailed notice thereof, the Victoria Planning
Commission met on March 4, 2008, at 7951 Rose in the Council Chambers.
#1 CALL TO ORDER & ROLL CALL:
Chair Simanton opened the meeting at
6:30 p.m.
Members Present: Chair, Gordy
Simanton; Commissioners: Bud Hiivala, Grant Peterson and Tom Vogt.
Members Absent: Commissioner
James Donadio III.
Others Present: Holly Kreft,
City Planner; Mayor Hershberger Thun; and Tanya Schmieg, Recording
Secretary.
A. Adopt Agenda
A motion was made by Hiivala, seconded
by Vogt, to adopt the agenda as presented. Vote: 4 Ayes, 0 Nays. Motion
Carried.
#2 APPROVAL OF MINUTES:
A. Minutes of the February 19, 2008
Planning Commission Meeting.
Commissioner Vogt corrected page 3,
paragraph 8 to read: Ms. Geheren said the only issues so far are the
private direct access points.
A motion was made by Simanton,
seconded by Vogt, to approve the Minutes as corrected above. Vote: 4 Ayes,
0 Nays. Motion carried.
B. Review Minutes from the February
14, 2008, City Council Meeting.
The above minutes were reviewed.
#3 PUBLIC HEARINGS:
None.
#4 NEW / OLD BUSINESS:
A. Review of Draft Ordinance
Amendment for Sidewalk Cafes as a Conditional Use in the Central Business
District:
1. Agenda Statement No. 08-05
2. Exhibits: Draft Ordinance Amendment, Sample Application for Use of
Right-away Permit.
Ms. Kreft stated the School of the
Wise has requested to allow outdoor seating and liquor. She noted this
portion of the sidewalk café ordinance would be for those using public
right-of-way.
Commissioner Hiivala commented on the
minimum of 48 inches and asked if there is enough room at the School of
the Wise. Ms. Kreft said yes, most sidewalk widths are 5 feet and the
School of the Wise also has a bump out which would also be considered
public right-of-way.
Commissioner Peterson commented on the
overhang of cars not reducing the 48 inches. He asked if this was modeled
after any other ordinance. Ms. Kreft said they used Alexandria’s and
Stillwater’s.
Commissioner Vogt stated there should
be some consideration for the type of space and the 48 inches should not
include places that have trees taking up sidewalk space. He noted he would
like to see it 60 inches. Commissioner Vogt said it should say a minimum
of 48 inches in addition to staff inspection and final approval. Ms. Kreft
said they recommended it be a conditional use permit so there would be
control over those issues. The first sentence in b. is intentionally vague
so there is city discretion.
Chair Simanton presented questions
from Commissioner Donadio. He said there has been extra trash in the
streets and is concerned with this contributing to that. Ms. Kreft said
they haven’t heard that issue, but one of the conditions will state that
appropriate trash receptacles need to be available.
Commissioner Donadio commented on this
ordinance increasing the outside sidewalk liquor sales. Chair Simanton
clarified that would fall within their liquor license.
Commissioner Donadio asked about the
deck at the Victoria House. Ms. Kreft said that is part of the private
property and they already have their liquor license that includes the
outdoor seating area.
Commissioner Donadio asked how many of
the on-sale licenses also have off-sale licenses. Ms. Kreft responded
there are three: The Victoria House, Schmitty’s and Floyds.
Commissioner Peterson asked if there
is a minimum requirement for sidewalks in the downtown area. Ms. Kreft
said the design standard width is about 10 feet. Commissioner Peterson
questioned sidewalk sales. Ms. Kreft said they will be adding a use of
public right-of-way permit, which would be more administrative.
Commissioner Peterson asked about the outside furniture requirements. Ms.
Kreft said there would be a timeframe of April 1st to about
October 15th. Commissioner Peterson asked if there are any
smoking restrictions for outside space. Ms. Kreft said she doesn’t know
what the regulations are.
Chair Simanton commented on the summer
peak time.
Chair Simanton suggested using a
percentage since there are different sidewalk widths. Ms. Kreft said the
language came from other samples and they would be open to that.
Commissioner Hiivala said that there should be some minimum for safety and
wheelchairs.
Chair Simanton recommended having
something on umbrellas and the size of them for safety.
#5 COUNCIL LIAISON UPDATE:
Mayor Hershberger Thun had nothing to
report.
#6 MISCELLANEOUS:
A. Communications.
Ms. Kreft provided a handout on the
new newsletter. Commissioner Hiivala suggested: View Victoria Today.
The Planning Commission discussed the
Highway 5 open house.
#7 ADJOURNMENT:
A motion was made by Simanton,
seconded by Hiivala, to adjourn the meeting at 7:00 p.m. Vote: 4 Ayes, 0
Nays. Motion carried.
