Lawful Gambling

Within the State of Minnesota, only registered nonprofit organizations may conduct lawful (charitable) gambling, such as bingo, raffles, paddle tickets, tipboards and pull-tabs. To determine what gambling license is required, please contact the State of Minnesota Gambling Control Board. The Gambling Control Board will provide you with the correct license forms. 

After receiving the license form from the Gambling Control Board, it must be submitted to the City for approval. Because gambling licenses must be approved by the City Council, please submit your application to the City at least 30 days prior to the desired City Council meeting date.

Regulations Around Lawful Gambling
City Ordinance:
City of Victoria Municipal Code Section 16-III – Lawful Gambling outlines the City's rules and requirements around lawful gambling within city limits. 

State Law:  
The City of Victoria operates within the framework of state law. Minnesota Statutes Section 349 and the Minnesota Gambling Control Board govern gambling in the state. All permit holders are required to be familiar with the provisions of this Chapter and with applicable Minnesota Statutes and federal regulations.

Permit Types
Premises Permits:
Premises permits are issued to an organization wishing to conduct lawful gambling at a specific location for a long period of time. 

For Premise license holders, the City of Victoria Municode Code Section 16-III requires specific spending requirements for gambling profits and expenditures:
  • The City of Victoria requires charitable gambling license holders to contribute up to 10% per year of net gambling profits to a fund that the city administers and regulates. The funds may only be spent by the city for charitable contributions allowed under state law.
  • The City also requires charitable gambling license holders to spend at least 50% of their lawful purpose expenditures within the City’s trade area. The City’s trade area is defined as areas within the city and township and services areas of the city fire department. 

Premises permits must be approved by City Council prior to being submitted to the state for final approval. Premises permits are to be approved by City Council through resolution. 

To obtain Council approval, you will need to:
  • Submit a completed state-issue form to the Victoria City Clerk at CityClerksOffice@ci.victoria.mn.us. Please contact the Gambling Control Board to receive the correct form.
  • Forms must be submitted to the City at least 30 days prior to the desired City Council meeting date. 

Following Council approval, the form containing the city’s approval will be sent to you. You are responsible for sending the approved form and any required documents to the Gambling Board for final approval.  

Current Premise Permit Holders:

Off-site Premises Permits:
Off-site Premises permits are issued to an organization wishing to conduct lawful gambling at a different location for which it does not hold a premises permit in conjunction with a county fair, the state fair, a church festival, or a civil celebration.  Up to twelve off-site events are allowed each calendar year, and each event is limited to three days. 

Off-site permits must be approved by City Council prior to being submitted to the state for final approval. Off-site permits are to be approved by City Council through resolution. 

To obtain Council approval, you will need to:
  • Submit a completed state-issue form to the Victoria City Clerk at CityClerksOffice@ci.victoria.mn.us  . Please contact the Gambling Control Board to receive the correct form.
  • Forms must be submitted to the City at least 30 days prior to the desired City Council meeting date. 

Following Council approval, the form containing the city’s approval will be sent to you. You are responsible for sending the approved form and any required documents to the Gambling Board for final approval.
